Sen. Lankford Exposes DOJ Memo for Violating Law & Promoting Abortion on Demand

WASHINGTON, DC – In December, the US Department of Justice (DOJ) Office of Legal Counsel (OLC) released a memorandum claiming that abortion drugs can be mailed into states that prohibit abortions—directly violating existing law. In response, Senator James Lankford (R-OK) sent a letter to Attorney General Merrick Garland condemning the Biden Administration’s willingness to jeopardize the health and safety of women to further the left’s abortion-on-demand agenda.

Lankford is joined on his letter by Senators Steve Daines (R-MT), Cindy Hyde-Smith (R-MS), Jim Risch (R-ID), Mike Crapo (R-ID), Marsha Blackburn (R-TN), Ted Cruz (R-TX), J.D. Vance (R-OH), Mike Braun (R-IN), Rick Scott (R-FL), Marco Rubio (R-FL), Mike Lee (R-UT), Roger Wicker (R-MS), Kevin Cramer (R-ND), Markwayne Mullin (R-OK), Josh Hawley (R-MO), Tommy Tuberville (R-AL), Roger Marshall, M.D. (R-KS), John Kennedy (R-LA), John Thune (R-SD), John Hoeven (R-ND), Ted Budd (R-NC). Representative Jim Jordan (R-OH) is leading this letter in the House of Representatives alongside Representatives Jim Banks (R-IN), Mary Miller (R-IL), Bob Latta (R-OH), Randy Feenstra (R-IA), Ben Cline (R-VA), Michael Guest (R-MS), Randy Weber (R-TX), Barry Loudermilk (R-GA), Paul Gosar (R-AZ), Mike Johnson (R-LA), Brad Wenstrup (R-OH), Alex Mooney (R-WV), Daniel Webster (R-FL), Andrew Clyde (R-GA), Robert Aderholt (R-AL), John Joyce, M.D. (R-PA), Chris Smith (R-NJ), and Marjorie Taylor Greene (R-GA).

The DOJ is Ignoring its Constitutional Responsibility

“It is disappointing, yet not surprising, that the Biden administration’s DOJ has not only abdicated its Constitutional responsibility to enforce the law, but also has once again twisted the plain meaning of the law in an effort to promote the taking of unborn life. The OLC memo should be immediately rescinded or, at minimum, redrafted to articulate an accurate application of the law,” the members wrote.

The DOJ’s Memo Violates the Law and Puts Women and Children at Risk 

“While the use of chemical abortion drugs may be legal in some States, and Federal law does not currently explicitly prohibit the use of such drugs, Federal law does prohibit the mailing or shipping of such items. Despite attempts to downplay this action, the ‘mere mailing’ of these items is expressly what the law has prohibited for nearly 150 years…The reckless distribution of abortion drugs by mail or other carriers to pregnant mothers who have not been examined in-person by a physician is not only dangerous and unsafe, it is criminal,”the members wrote.
